IDENTIFAI.US USER AGREEMENT Version: 1.2 Agreement Created: December 02, 2025 By accepting this agreement, the user acknowledges and agrees to the following terms: ====================================================================== REQUIRED: SMS CONSENT FOR ACCOUNT HOLDER ====================================================================== Business Name: Identifai.us I agree to receive text messages from Identifai.us for the following purposes: 1. Campaign Delivery Notifications - Updates about your phishing training campaigns Example: "Your campaign 'Q4 Security Training' was sent to 50 employees" 2. Account Notifications - Important updates about your account status Example: "Your monthly usage limit has been reached" or "Payment processed successfully" 3. Security Alerts - Critical security and compliance notifications Example: "Unusual login activity detected on your account" 4. Customer Care - Support responses and service updates Example: "Your support ticket #12345 has been resolved" 5. Fraud Alerts - Notifications about suspicious activity Example: "Multiple failed login attempts detected" Message Frequency: Message frequency varies. You may receive 1-10 messages per month depending on your campaign activity and account usage. Opt-Out Instructions: Reply STOP to unsubscribe from SMS messages at any time. If you opt out, your phone number will be added to our do-not-contact list and you will not receive further messages unless you opt back in by contacting support@identifai.us. RECIPIENT CONSENT REQUIREMENT You are responsible for obtaining proper written consent from ALL recipients before sending SMS training campaigns through Identifai.us. You will only send messages to phone numbers where you have documented consent. 2. REQUIRED CONSENT ELEMENTS Consent obtained from recipients must include: - Business name (your organization or Identifai.us) - Message type (cybersecurity training, phishing simulations) - Message frequency disclosure - Opt-out instructions (Reply STOP to unsubscribe) - Help instructions (Reply HELP for assistance) - "Message & data rates may apply" disclosure 3. CONSENT DOCUMENTATION You agree to maintain records of all consent obtained (e.g., employment agreements, IT policies, explicit opt-in forms) and provide documentation if requested. 4. OPT-OUT COMPLIANCE You agree to respect opt-out requests immediately and remove opted-out numbers from future campaigns. ====================================================================== 1. TRAINING AND EDUCATIONAL PURPOSE This service is intended solely for training and educational purposes related to cybersecurity awareness. 2. CONSENT TO SEND PHISHING CAMPAIGNS The user gives Identifai.us consent to send email and SMS phishing campaigns to provided email addresses and phone numbers as a service. 4. DATA COLLECTION AND USE Identifai.us will collect and maintain: - User-provided email addresses for phishing simulation - User-provided phone numbers for SMS phishing simulation - User login email address - User-created email templates and SMS templates - IP addresses for auditing purposes only 5. DATA SECURITY Identifai.us will keep all user-provided data as secure as possible using industry-standard practices. 6. COMPANY TEMPLATE USAGE If the user generates company templates, the user agrees to let Identifai.us use their likeness for training and educational purposes, including logos, company names, and employee names. 7. COMMUNICATION CONSENT The user agrees to receive emails and SMS messages from Identifai.us regarding phishing attempts and service updates. 8. ETHICAL AI USE The user agrees that AI tools should be used for good and not for malicious intent. 9. UPDATES TO TERMS Identifai.us may update the Terms of Service and Privacy Policy from time to time. When material changes are made, users will be required to review and accept the updated terms before continuing to use the service. Continued use after accepting updated terms constitutes agreement to the new versions. TERMS OF SERVICE Effective Date: December 02, 2025 1. Service Description Identifai.us is a social engineering training platform that provides cybersecurity awareness and other social engineering techniques for educational purposes only. 2. Acceptable Use You agree to: - Use the service only for legitimate cybersecurity training - Not use the service for malicious purposes - Comply with all applicable laws and regulations including CAN-SPAM Act, TCPA, and GDPR - Only target email addresses and phone numbers within your organization or with proper consent - Provide clear identification that messages are training simulations 3. User Responsibilities You are responsible for: - Obtaining proper consent before sending campaigns: * Email Campaigns: Ensure recipients have agreed to receive training emails, typically through employment agreements, IT policies, or explicit opt-in * SMS Campaigns: Obtain written consent that includes business name, message type, frequency, opt-out instructions (STOP), help instructions (HELP), and "message & data rates may apply" disclaimer * Document all consent obtained and maintain records * Respect opt-out requests immediately - Ensuring compliance with your organization's policies - Maintaining the security of your account - All content created using our platform 4. Service Availability We strive to maintain service availability but do not guarantee uninterrupted access. We may perform maintenance or updates as needed. 5. Limitation of Liability Our liability is limited to the maximum extent permitted by law. We are not responsible for any indirect, incidental, or consequential damages. 6. Termination We may terminate or suspend access to our service for violations of these terms or for any reason with notice. 7. Changes to Terms We may update these terms at any time.
